Former police officer Derek Chauvin's murder trial for the death of George Floyd has been delayed for at least a day as the judge contends with a last-minute order by a higher court to reconsider adding an additional murder charge.

The trial was scheduled to begin on Monday (local time) with the screening of jurors who will weigh murder and manslaughter charges against the former Minneapolis police officer.

The case is seen as a referendum on police violence against Black Americans.

Mr Chauvin appeared in court dressed in a navy blue suit and tie, a white shirt and a black face mask, jotting notes in a yellow legal pad on the table before him.

Hennepin County District Court Judge Peter Cahill set aside three weeks for jury selection alone, mindful of the difficulties of finding impartial jurors in a case that prompted widespread protests across the US and saw Mr Floyd become an international icon of racial justice.

But the hearing was delayed at the urging of prosecutors.

The Minnesota Court of Appeals told Judge Cahill he must reconsider prosecutors' request to also reinstate a third charge of third-degree murder in an order issued on Friday.

Mr Chauvin's defence lawyer, Eric Nelson, told the court on Monday morning that Mr Chauvin would ask the Minnesota Supreme Court to overturn Friday's order, a process that could take weeks, although he saw no reason for that to delay jury selection.

Prosecutors from the Minnesota attorney general's office urged the court to delay jury selection until the appeal was resolved.

Prosecutors fear picking a jury while a number of charges are still unresolved could make it easier for Mr Chauvin to appeal a verdict later, Mr Frank said.

However, Judge Cahill declined, repeatedly saying he believed he was entitled to at least begin seating jurors unless a higher court ordered him not to.

Prosecutors then said they would ask the Appeals Court to intervene to delay the trial.

Judge Cahill suspended jury selection until at least Tuesday.

Mr Chauvin, 44, is charged with second-degree murder, which carries a sentence of up to 40 years in prison, and manslaughter.

He was released from jail on a $1 million bond last October and will be tried in a courtroom in the Hennepin County Government Center, a tower in downtown Minneapolis now ringed with fencing and concrete barricades for fear of disruption by protesters.

The courtroom has been adapted to mitigate the spread of coronavirus.

Judge Cahill limited attendance, with one seat each allocated to the Chauvin and Floyd families.

Mr Floyd's sister, Bridgett Floyd, went inside for the first day. No one took the seat reserved for Mr Chauvin's family.

Lawyers for Mr Chauvin, who was fired from the police force the day after Mr Floyd's death, have argued that he correctly followed his training in helping colleagues arrest Mr Floyd on suspicion of using a counterfeit $20 bill at grocery store.

The medical examiner ruled that Mr Floyd's death was a homicide caused partly by police restraint holds.

But the autopsy report also noted that Mr Floyd had recently ingested the opioid fentanyl, and Mr Chauvin's lawyers contend that an overdose was the main cause of death.
